Former FBI Director James Comey is set to face trial in October due to a social media post involving an image of seashells. A U.S. District Judge scheduled the trial for October 21 in North Carolina. The controversy centers on an Instagram photo where Comey displayed seashells arranged to form the numbers ‘8647.’
The federal grand jury in the Eastern District of North Carolina indicted Comey, claiming the image implied intent to harm President Donald Trump. In restaurant jargon, ’86’ signifies that an item is unavailable or should be removed, which plays a role in the case.
Comey plans to contest the charges by filing motions to dismiss. His defense argues that the prosecution is selected and vindictive. Judge Louise Flanagan documented Comey’s intentions in her order. Provided the case withstands these motions, Comey will appear at an arraignment on September 30 at a federal courthouse in New Bern, North Carolina.
This situation follows an earlier victory for Comey in a related case in Virginia. There, the court ruled against Trump loyalist Lindsey Halligan, citing improper appointment procedures in her appearance before a grand jury.
The Justice Department asserts that Comey’s Instagram post threatened Trump. This case emerges amid other legal challenges faced by the Trump administration. Recent federal grand jury decisions have thwarted administration attempts in various cases, including rejecting indictments against Democratic lawmakers and reprimanding prosecutors for conduct in an anti-ICE protest case.
Key dates in Comey’s case include due submissions for pretrial motions by July 28, responses by August 18, and replies by September 1.
