The Supreme Court declined to reinstate Carter Page’s lawsuit against former FBI officials on Monday. Justice Ketanji Brown Jackson recused herself from the decision. This ruling concludes Page’s efforts to hold FBI leaders accountable for surveillance mistakes related to the Russia investigation.
The outcome finalizes the case against former officials, including James Comey, by cementing a lower-court judgment that deemed his claims were filed too late. The justices issued an unsigned order rejecting Page’s appeal, thereby maintaining a federal appeals court decision stating a three-year statute of limitations barred his claims.
Page contended the timeframe should have initiated in 2019 when a Justice Department inspector general highlighted significant errors in the FBI’s surveillance process. Despite suing in 2020, courts disagreed. Although Justice Jackson did not participate, the Court did not provide a rationale for her recusal, in line with customary practice.
