Lawmakers on Capitol Hill expressed varied opinions on the Supreme Court’s decision to reject former President Donald Trump’s attempt to end birthright citizenship. This ruling allows children born in the United States to retain recognition as U.S. citizens.
Republican and Democratic Responses
Rep. Byron Donalds, R-Fla., criticized the decision, stating, “It’s a terrible decision.” He emphasized the need for regulation before entry into the country, not post-birth adjustments.
Democrats hold a different view. Rep. Ro Khanna, D-Calif., mentioned the importance of regulating the immigration process before an individual’s birth in the U.S., without altering citizenship after birth.
Context of the Case
The case challenged Trump’s executive order aiming to dissociate birthright citizenship from the 14th Amendment. Democrats largely viewed a contrary ruling as unconstitutional. Rep. Christian Menefee, D-Texas, agreed with the Supreme Court’s decision, stating, “The Constitution says what it says.” His sentiment was shared by other Democrats.
Rep. James Clyburn, D-S.C., reinforced the significance of the Constitution, suggesting amendments if changes are desired. Rep. Seth Magaziner, D-R.I., noted bigger national issues beyond birthright citizenship.
Impact on Trump’s Agenda
The 6-3 decision marks a setback for Trump’s immigration policies, which highlighted birthright citizenship as a factor in illegal immigration. Rep. Sarah Elfreth, D-Md., criticized Trump’s stance as harsh on immigrants.
Dissent and National Security Concerns
Justices Clarence Thomas, Neil Gorsuch, and Samuel Alito dissented, arguing the 14th Amendment does not assure birthright citizenship for children born to unauthorized or temporary residents. Justice Alito cited concerns over “birth tourism” posing potential security threats.
Some lawmakers, including Rep. Ilhan Omar, D-Minn., and Rep. Maxine Waters, D-Calif., declined to comment.
Rep. Bennie Thompson, D-Miss., celebrated the ruling, appreciating how it upheld constitutional interpretation over individual opinions.
