President Donald Trump recently commented on a Democratic resolution aimed at ending the Senate filibuster and expanding the Supreme Court. In a Truth Social post, he encouraged Republicans to act swiftly to prevent the Democrats from taking these steps. Trump warned that the Republican Party might lose future elections if they did not take action.
His statement highlighted a new Democratic resolution as a reason for Republicans to act first. This comes a few months before the midterm elections, where Democrats hope to regain control of Congress after the Republicans’ win in both the House and Senate in 2024. Historically, the party in the White House tends to lose seats during the midterms.
Democratic Plans
Trump’s post mentioned Democrats’ intention to terminate the filibuster and expand the Supreme Court, citing a Politico article about a resolution from June 24. This resolution, backed by minority caucus leaders, calls for changes in the court structure and an end to the filibuster.
Trump has been vocal about ending the legislative filibuster. The filibuster typically requires 60 votes to advance most legislation. Supporters claim it encourages compromise and protects minority-party rights. Critics believe it obstructs bills supported by most senators.
A May Marquette Law School Poll revealed that 50 percent of Americans support court expansion, while 50 percent oppose it. The poll surveyed 1,001 adults with a margin of error of plus or minus 3.4 percentage points.
Court Expansion and Voting Rights
The Supreme Court has had nine justices since 1869, although this number has changed in U.S. history. Some Democrats, following the confirmation of three conservative justices during Trump’s term, advocate for court expansion. These justices gave conservatives a strong majority, affecting major rulings on issues like abortion and voting rights.
The resolution from Congress calls for restoring the Voting Rights Act and considering structural reforms for the Supreme Court. Introduced by Representative Greg Casar, it includes elimination of the 60-vote threshold and possible court expansion. However, it faces significant hurdles in the current Republican-controlled Congress.
The resolution also addresses voting rights following the Supreme Court’s ruling in Louisiana v. Callais, which weakened Section 2 of the Voting Rights Act. This section opposed voting practices that diluted minority voting power. Trump supported this ruling.
Impact on Upcoming Elections
With four months until the midterms, Democrats are ahead in polls to take control of the House. They are optimistic due to better performance in recent special and state elections and Trump’s declining approval rating. Currently, Republicans lead the House 218-212, so Democrats need only a few seat flips to win control.
Despite potentially regaining Congress, Democrats would still face challenges in eliminating the filibuster or expanding the court, needing strong party support. Upcoming primary elections continue, with the general election on November 3.
