Background of the Lawsuit
David Streever is an upstate New York resident who has taken legal action against U.S. Immigration and Customs Enforcement (ICE). The lawsuit alleges a violation of his First Amendment rights after federal officers came to his residence over an email he sent.
While Streever was in Finland, U.S. officers visited his Rochester home in June, presenting a warning notice to his wife. This notice stated that an email he sent in January was considered a threat, according to statements by his attorneys.
Details of the Email Incident
Streever sent the email to Todd Lyons, the acting director of ICE at the time, following the shooting of Minneapolis resident Renee Good by an immigration officer during a protest. In the email, Streever referred to Lyons harshly, expressing disapproval of his actions and stating that Lyons would never find peace.
The email drew a parallel to a historical figure, describing Lyons as akin to a Nazi leader.
Legal Response and Representation
The Foundation for Individual Rights and Expression represents Streever, emphasizing the issue of free speech protection under the First Amendment. Adam Steinbaugh, an attorney with the foundation, asserted that the warning violates Streever’s rights as it pertains to political speech.
ICE representatives have not commented on the situation due to an ongoing investigation. However, Homeland Security Secretary Markwayne Mullin denied any efforts to suppress free speech, stating that threats to law enforcement would be addressed.
Similar Case Involving Paigelynne Gonyea
Streever isn’t the only upstate New York resident served with a warning from federal agents. Paigelynne Gonyea, a poll worker, also received a visit from officials due to a social media post regarding Jonathan Ross, the officer who shot Good.
Gonyea’s post included a sentiment about wishes for Ross’s indictment and shared Ross’s address, which resulted in claims of committing a federal crime by doxxing a law enforcement officer. Lauren Bis from the Department of Homeland Security commented on this, affirming that such actions would lead to investigations and legal consequences.
Review by New York Attorney General’s Office
The New York Attorney General’s Office is aware of the incidents involving Streever and Gonyea and is reviewing the federal agents’ interactions with Gonyea at polling locations. The office aims to ensure that all interactions were conducted lawfully.
