President Donald Trump’s lawsuit against the Internal Revenue Service (IRS) was condemned by a U.S. District judge for being filed with an “improper purpose.” The $10 billion complaint, according to U.S. District Judge Kathleen Williams, was an exercise in self-dealing, and she referred one of Trump’s lawyers for discipline.
Judge Williams accused Trump of manipulating the court system by suing a federal agency under his control. This maneuver bypassed the requirement that parties in a lawsuit must have adverse interests. The lawsuit led to a settlement that granted Trump immunity from tax audits and established a fund to compensate his allies who claim unjust persecution.
Although the impact of the ruling might be limited given the administration’s statements that the $1.776 billion Anti-Weaponization Fund has been abandoned, the judge’s decision arises as a politically damaging matter for Acting Attorney General Todd Blanche. He is set to face the Senate Judiciary Committee for his confirmation hearing soon.
The nature of the suit itself and the conduct of the Parties and counsel from its filing make plain that this was an attempt to use the Court to provide some legitimacy to an agreement to confer immunity to people and entities affiliated with the President and to earmark billions of dollars from American taxpayers to redress grievances not defined in the law,” Williams wrote in her ruling.
Judge Williams emphasized that the president, despite his position, is bound by the rules that govern civil suits. She highlighted her duty to ensure that courts are used for their genuine constitutional purposes.
The judge cited Todd Blanche’s congressional testimony from June, where he mentioned that the “anti-weaponization” fund was no longer progressing due to bipartisan criticism. Although nothing had been filed in court regarding this fund, Blanche seemed confident that he could represent both sides of the matter.
Acting Attorney General Blanche’s apparent capacity to speak for both Plaintiffs and Defendants, sign a ‘settlement’ document on behalf of all Parties to this action, and then repudiate part of that agreement, demonstrates that there was only one party whose interests were being represented throughout this case,” the judge wrote.
This misrepresentation raised questions about the legitimacy and intent of the entire lawsuit. The implications for the President and his administration could have significant legal and political ramifications.
