Legal Battle Ends Over Release of Biden’s Interview Recordings

Former President Joe Biden’s legal struggle regarding the release of his interview recordings concluded on Monday. These recordings, acquired during an investigation by special counsel Robert Hur, came from interviews with Biden’s memoir ghostwriter. Biden’s legal team filed a motion last week to cease efforts to block the release, citing his status as a private citizen and no longer pursuing public office. Judge Tanya Chutkan of the U.S. District Court for the District of Columbia accepted this dismissal.

The Justice Department now has clearance to present the audio and transcripts to the House Judiciary Committee. The recordings involve conversations from 2016 and 2017 with Mark Zwonitzer, the ghostwriter for Biden’s memoir “Promise Me, Dad.” Hur’s investigation focused on Biden’s management of classified documents from his vice-presidency and Senate tenure. Despite uncovering classified information concerns, Hur did not pursue criminal charges. He did not find sufficient evidence that Biden willfully mishandled the documents. Moreover, Hur reasoned that Biden might appear to a jury as a “sympathetic, well-meaning, elderly man with a poor memory” rather than a deliberate law violator.

The Heritage Foundation, a conservative organization, pushed for over two years to access these materials via FOIA requests. They claimed public interest in understanding the recordings and transcripts that influenced Hur’s decision. Fox News Digital contacted the Heritage Foundation for remarks, but none were provided by the publication time.

A court ruling previously favored the Heritage Foundation. In a recent outcome, a divided panel of the U.S. Court of Appeals for the District of Columbia Circuit stated that the public interest in disclosing the now-redacted materials outweighed privacy concerns.

In a surprising shift, the Justice Department decided in February to disclose redacted recordings and transcripts to both the Heritage Foundation and the House Judiciary Committee. Biden’s attorneys did not reply to inquiries from Fox News Digital on the matter.
