The Justice Department has approached a federal appeals court, requesting the reinstatement of criminal charges filed against Kilmar Abrego Garcia, a Salvadoran national. Federal authorities had deported Abrego Garcia under the Trump administration. A previous court ruling in Tennessee had found the charges vindictive and dismissed them.
Earlier this year, a federal judge dismissed the human smuggling charges against Abrego Garcia. The judge believed that the charges were in retaliation for Abrego Garcia’s efforts to contest his wrongful deportation to El Salvador. However, the Justice Department argues that the prosecution was justified, stating that career prosecutors had a firm basis for the indictment based on evidence and legal principles.
According to a filing with the U.S. Court of Appeals for the 6th Circuit, the Justice Department insists there were multiple valid reasons to prosecute Abrego Garcia. They emphasized that the prosecution’s decision cited proof beyond a reasonable doubt.
A statement from the Justice Department expressed concerns over the May ruling. They warned that it could expand courts’ powers to dismiss serious charges based on perceived prosecutorial motives. CBS News has reached out to Abrego Garcia’s legal team for a response.
The charges against Abrego Garcia arose from an incident in November 2022, when Tennessee Highway Patrol stopped his vehicle and discovered several people inside. He pleaded not guilty to two counts of human smuggling.
Abrego Garcia is also contesting a separate case in Maryland involving deportation efforts under the Trump administration. While Immigration and Customs Enforcement aims to deport him to Liberia, a federal judge has currently stayed this action.
