Federal Judge Blocks Extradition Attempt
A federal judge has halted Minnesota’s efforts to extradite Christian Castro, an Immigration and Customs Enforcement (ICE) agent, from Texas. This legal action comes after Castro was indicted in Minnesota in connection with the January shooting of Julio Cesar Sosa-Celis, a Venezuelan migrant. The incident occurred during Operation Metro Surge in Minneapolis.
Allegations Against Castro
Federal prosecutors accused Castro of making false statements after the shooting. They allege Castro fired through the front door of a Minneapolis residence, injuring Sosa-Celis. Following the shooting, which coincided with heightened immigration enforcement by the Trump administration in Minnesota, unrest erupted in Minneapolis.
Governor Abbott’s Response
Despite these charges, Texas Governor Greg Abbott has not signed an extradition warrant to transfer Castro to Minnesota. Under Texas law, unless extradition is executed, detainees must be released after 90 days in custody. Castro was released from a Texas detention center after Abbott’s intervention.
Legal Challenges and Dismissed Charges
Minnesota Attorney General Keith Ellison sought a temporary restraining order to prevent Castro’s release or to mandate his return to Minnesota. This effort was not successful. Castro faces separate charges in Minnesota, including assault and false reporting related to the shooting.
Conflicting Accounts and Evidence
Initial reports suggested that Sosa-Celis and another individual assaulted officers with a broom handle and snow shovel. However, video footage contradicted these claims, leading to the dismissal of charges against Sosa-Celis. Further investigations were initiated as a result.
Limitations on Federal Charges
According to a report from ProPublica, federal prosecutors were hindered by Washington officials from pursuing civil rights charges against Castro. Federal authorities, including the Department of Justice, have yet to comment on the situation, but inquiries have been made to ICE and the Department of Homeland Security.
