A North Carolina law has given Prisha Mosley the opportunity to appeal her previously dismissed malpractice lawsuit against doctors who led her to undergo hormone therapy and a double mastectomy. Mosley’s legal case, initially dismissed due to time constraints, has gained a second chance as the state Court of Appeals prepares to hear arguments on September 29.
Background on the Case
Mosley, now 28, received hormonal treatments at 17 and had a double mastectomy at 18. She later sued her medical providers, accusing them of misleading her about the necessity and effects of such treatments. In an interview, Mosley expressed regret, stating the treatments did not bring happiness or well-being.
Initially, a North Carolina trial court dismissed her lawsuit based on the statute of limitations. Mosley explained that a law passed in the state in 2025 extended these limitations specifically for those who had undergone gender transitions.
“During the process through which my lawsuit was going through the courts, North Carolina passed HB 808, which was previously HB 805,” she said. “[The law] extended the statute of limitations for anyone bringing forward a civil case, and even had a line which said that this includes cases that have already been brought forward or pending.”
Legislative Action and Legal Proceedings
The law, passed in July 2025, aimed to protect individuals in similar situations. Nevertheless, her case was still dismissed the following month, with the court granting summary judgment to the plaintiffs, despite previous findings that her fraud allegations had merit.
Mosley argued that she was misled into believing she could change sex and undergo male puberty, criticizing the assurances she received as falsehoods. “The judge actually originally found that my case did have merit for fraud,” she noted, emphasizing that she was falsely promised outcomes that were not feasible.
Appeal and Broader Implications
After the lawsuit’s dismissal, her lawyers appealed, and the appellate court will now hear the case. Mosley highlighted that despite her claims being dismissed before reaching a jury, the public recognizes the wrongdoing involved in such medical practices.
She cited a recent New York ruling where Fox Varians, another detransitioner, succeeded in a similar lawsuit, winning $2 million from healthcare providers.
Mosley underlined the challenge detransitioners face in receiving justice, as procedural hurdles often prevent their cases from proceeding to trial. “None of our cases have ever failed in court. We’re being stopped by strange policies and statutes of limitations before we ever go before a jury,” she explained.
