The Fairfax County Sheriff’s Office, located in Virginia, reportedly ignored approximately 1,670 immigration detainers from U.S. Immigration and Customs Enforcement (ICE) between 2023 and 2025. These actions resulted in releasing criminal illegal immigrants rather than transferring them to federal custody. This information comes from a new report by the House Judiciary Committee.
The interim staff report, obtained by Fox News, details these findings. Released by the Subcommittee on Immigration Integrity, Security, and Enforcement, the report also criticizes Fairfax County Commonwealth’s Attorney, Steve Descano. It accuses Descano of treating illegal immigrant defendants with more leniency than similarly situated American citizens to reduce their immigration repercussions.
This interim report provides evidence of how one local jurisdiction applied policies allowing dangerous foreign nationals to avoid deportation and potentially reoffend.
The report highlights concerns about sanctuary policies and their implications for national security and community safety. It argues that these policies might allow individuals to escape accountability.
A preliminary review of more than 1,100 criminal cases identified over 100 unreported illegal immigrants benefiting from prosecutorial decisions. Descano’s office reportedly seldom pursued charges for crimes such as DUI, felony drug possession, grand larceny, and assaulting law enforcement officers.
The committee accuses Descano of de facto decriminalizing certain offenses, noting that defendants often reoffended with escalating severity. The report alleges that Descano misled Congress about the scope of his policies, citing past testimony attempting to prioritize legal permanent residents in cases involving minor crimes.
The committee noted numerous cases where charges were reduced or dismissed, allowing defendants to face lesser consequences. One highlighted case involved reducing felony sexual assault charges to misdemeanors, resulting in minimal sentences.
The report outlines cases where ICE detainers were ignored, leading to further criminal actions by released individuals. It highlights the influential role local policies play in broader law enforcement efficacy.
Steve Descano, facing criticism, continues to defend his policies, emphasizing fairness in prosecutorial decisions. Meanwhile, critics persistently argue for a reassessment of practices to prioritize public safety.
