A federal judge has ruled that the First Amendment protects a person’s right to possess AI-generated images or videos depicting child sexual abuse, provided these do not depict real individuals and are kept private at home. This decision was made on Tuesday by a federal appeals court judge. It challenges existing laws formed before the emergence of AI technologies, which now allow for the creation of lifelike fake images of children.
The ruling specifically pertains to images that do not portray real people. The judge has called upon the Supreme Court to revisit legal precedents established before significant AI developments.
