An attorney from a nonprofit focused on the First Amendment believes President Donald Trump is unlikely to succeed in a legal dispute with three media companies he barred from the White House. Last Friday, after declaring a ban on CNN, MS NOW, and Politico, the White House indicated Trump remains resolute despite the resulting lawsuit.
Aaron Terr, director of public advocacy at the Foundation for Individual Rights and Expression (FIRE) in Philadelphia, stated, “I think the Trump administration will not fare well in court because its action here is blatantly unconstitutional.” Trump announced on TRUTH Social that employees from these media outlets were prohibited from the White House due to “reporting FAKE NEWS,” claiming they “shouldn’t be able to constantly write or report FICTION and LIES when covering the President of the United States.”
Terr noted, “There’s settled precedent that when the White House opens its doors to the press, which it has done, the First Amendment walks in too.” He explained that this prevents the administration from banning reporters based on their viewpoints or critical coverage and cited Trump’s explicit reasoning for banning the outlets.
“Reporters from CNN, MS NOW, and Politico found alternative spots to report from Pennsylvania Ave. instead of the White House grounds over the weekend,” noted Terr. “This underscores their determination.”
The three news organizations filed a lawsuit against Trump, seeking a temporary halt to the ban and requesting the court to restore their White House credentials. Scheduled CNN coverage by the White House was not replaced by fellow pool networks including Fox News Media, ABC News, CBS News, and NBC News, as they released a joint statement emphasizing the public’s need for accurate, independent information.
The White House Correspondents’ Association (WHCA), led by Fox News’ Jacqui Heinrich, supported the media outlets, stating the action violated the First Amendment and warning of the broader implications for future press freedom.
Terr stated that although no one has a guaranteed right to report from the White House, precedent maintains that granted access cannot be revoked due to ideological biases. He emphasized that government retaliation for protected speech is impermissible.
“The First Amendment is crafted to prevent governmental control over media,” Terr added, highlighting the importance of free and independent reporting for public scrutiny of those in power.
