An Australian appeals court has ordered Erin Patterson, convicted of triple murder, to remain in prison indefinitely due to the severe nature of her crimes. She poisoned four of her ex-husband’s relatives using death cap mushrooms.
The Victoria state Court of Appeal’s three judges denied Patterson’s appeal and endorsed the prosecution’s request to revoke her previously assigned 33-year nonparole sentence. As a result, she will spend her entire life in prison instead of being eligible for release in her eighties.
“This offending was extraordinarily cold and calculated and stands to be denounced in the strongest terms,” said Justice Stephen McLeish.
Erin Patterson now joins Katherine Knight as one of the only two women in Australia sentenced to life without parole. Knight was convicted in 2001 for murdering her partner in New South Wales.
Patterson’s crimes unfolded during a family meal in Leongatha, July 2023. Convictions were related to the deaths of her estranged parents-in-law Don and Gail Patterson, and Gail’s sister, Heather Wilkinson, shortly after dining at her home. The meal also left Heather’s husband, Ian Wilkinson, hospitalized, though he survived the incident.
Patterson maintains that the inclusion of death cap mushrooms in the meal was accidental. These mushrooms are responsible for 90% of fatal mushroom poisonings worldwide, according to the BBC.
In 2022, a similar poisoning case involved a mother and son in Massachusetts, who survived the ordeal. A 2020 poisoning in Victoria resulted in one death and seven hospitalizations.
Patterson was previously sentenced to three life terms for murder and an additional 25 years for attempted murder. The high-profile case drew international attention, resulting in books, podcasts, and even a TV series adaptation starring Emmy-nominated actor Melanie Lynskey.
Ian Wilkinson, the lone survivor, testified about Patterson’s deceptive tactics, including fabricating a cancer diagnosis to excuse her children’s absence from the meal.
Justice McLeish highlighted Patterson’s deliberate deception and destruction of evidence. As a high-profile inmate, she is housed in Melbourne’s high-security Gordon Unit to ensure her safety from other prisoners.
Patterson’s estranged husband, Simon Patterson, did not attend the meal after suspecting a threat to his life. His suspicions were reportedly documented in pretrial evidence.
