Customer Discovers Cow Tooth in Taco, Files Lawsuit Against Torchy’s Tacos

In a surprising incident, a Texas woman named Nohemi Castillo found a cow tooth in her taco from Torchy’s Tacos. This unexpected discovery has led her to file a lawsuit against the popular restaurant chain. The incident took place on June 9 at the South Congress Avenue location in Austin and was reported in a lawsuit filed on October 13 in Travis County District Court.

The restaurant confirmed that the object found was indeed a cow tooth. According to Torchy’s Tacos, this rare occurrence can happen when processing the meat. Their statement clarified that the barbacoa used in the tacos comes from natural beef cheek supplied by a dedicated source. Torchy’s stated they are taking measures to prevent such incidents by working closely with their supplier.

Attorney Scott Vasquez, representing Castillo, mentioned that Torchy’s initially did not acknowledge the object as a cow tooth until media reports surfaced. During this time, additional evidence, such as photographs showing the tooth next to a tape measure, was provided. These photos aim to demonstrate the size of the object Castillo almost ingested.

Witness accounts add that a colleague observed Castillo pulling something from her mouth during lunch. Initially thought to be a bone, it was soon identified as a tooth, leading to Castillo feeling disgusted and unwell. This prompted her to seek medical attention, incurring expenses and enduring physical pain and mental distress.

The lawsuit accuses Torchy’s Tacos and Success Foods Management Group of negligence. It suggests they failed in preparing, inspecting, and distributing food safely. Castillo alleges violations of the Texas Deceptive Trade Practices Act and federal food safety standards, claiming she would not have purchased the meal had she known about the defect.

Castillo seeks monetary relief of up to $250,000, with the final amount to be set by a jury. Her attorney indicated that more people have shared similar experiences with Torchy’s Tacos, though these claims remain unverified.

Despite the allegations, Torchy’s Tacos asserts they took the complaint seriously, conducting a comprehensive review. However, they did not provide a detailed response when requested for comment.
