ICC Chief Prosecutor Suspended Amid Misconduct Allegations

In an unusual move, the International Criminal Court’s chief prosecutor, Karim Khan, has been suspended from his duties. Allegations of sexual misconduct with a female aide have been unresolved for over two years. Khan has consistently rejected these accusations.

The Assembly of States Parties, overseeing the ICC, will decide Khan’s future at a special session. The Bureau of the Assembly, part of the court’s oversight, announced its decision citing a report by the United Nations Office of Internal Oversight Services, supporting evidence, a judicial panel’s advice, and written submissions. The suspension does not predict the final result.

The U.N. investigation unearthed claims of Khan having nonconsensual sexual contact with the aide at various locations. However, a panel of judges deemed the investigation incomplete. Khan’s legal team intends to provide a statement soon.

This process is a first for the ICC, necessitating new procedural rules. Allegations first reached the court’s independent watchdog years ago. Whistleblower reports suggest Khan moved the woman to his office and engaged in inappropriate conduct during official trips, including asking her to join personal vacations.

Only the Assembly of States Parties holds the authority to remove Khan, requiring a majority from its 125 members. No date is set for the session, but it will convene promptly.
