In a significant development in Avenal, California, four city officials have been ordered to step down following their refusal to leave office despite a recall vote earlier this year. The ruling was made by Kings County Superior Court Judge Jennifer Giuliani, emphasizing the illegality of their continued tenure.
These officials include the longstanding mayor and three members of the city council. They maintained their positions post-recall, claiming the process was unauthorized. This situation has led to one of the most contentious recall disputes in recent California history and is notable for its resemblance to election denialism.
Judge Giuliani’s decision stated that the officials do not lawfully hold their positions, and the offices have been vacant since the election results were certified on May 28. She asserted that, although the election had procedural irregularities, these did not compromise its validity or outcome.
“The ultimate issue is not close. The court must uphold the will of the electorate, and Avenal voters have spoken decisively,” Judge Giuliani wrote. She stressed that not honoring the election results would undermine democratic principles.
Furthermore, the court’s decision permits recalled mayor Alvaro Preciado to run in the upcoming general election on November 3.
Avenal’s city manager, Antony V. López, expressed respect for the court’s ruling. In a statement, he mentioned that validating the court’s jurisdiction was crucial for maintaining the city’s municipal authority rather than relinquishing it without question.
