Maricopa County Reaches Settlement on Election Administration

Maricopa County in Arizona has found itself at the center of election contention since the 2020 presidential election when President Biden won the state. Recently, county officials reached a critical agreement to manage their election processes. This resolution ends a prolonged dispute that might have jeopardized the county’s democratic integrity.

The jurisdiction of election responsibilities in Arizona is divided between the county’s board of supervisors and the county recorder. However, in Maricopa County, disagreements existed over the specific duties handled by each party. The county recorder, who supports former President Trump and has refused to verify the fairness of the 2020 and 2022 elections, sued the Republicans leading the county board. He argued that they had unlawfully taken over some election responsibilities, including funding and tech systems.

On the other side, the board contended that the recorder, Justin Heap, aimed to undermine the elections by creating confusion. After extensive late-night bargaining and involvement from the State Supreme Court, a legal settlement has been reached. The emergency board meeting on Tuesday ratified this compromise.

The settlement clearly delineates responsibilities: the board will predominantly oversee Election Day operations and vote counting. Meanwhile, Mr. Heap’s office will control voter registration and early voting. Additionally, the board allocated as much as $15 million for a new IT system for the recorder’s office and promised financing for several new job positions.

At the meeting, Tom Galvin, one of the county’s Republican supervisors, remarked, “This settlement agreement now provides an off-ramp from this highway to hell that we’ve been on. It’s not perfect, but overall it provides certainty for how we move forward in running elections.”
