New York City Settles $131 Million with DoorDash Over Delivery Driver Tips

New York City Mayor Zohran Mamdani criticized DoorDash CEO Tony Xu for promoting what he referred to as a ‘greedy algorithm’ at a news conference announcing the city’s $131 million settlement with DoorDash. The settlement came after claims that the company withheld delivery driver tips.

According to Mamdani, Xu’s remarks from a July podcast advocated for business owners to maximize profits, even when it meant prioritizing short-term gains without considering long-term consequences. Mamdani highlighted how this approach has negatively impacted many delivery workers in New York City.

The $131.5 million settlement, announced by Mamdani, is significant as it represents the largest financial resolution for food delivery workers in any American municipality to date. Out of this amount, $115 million is designated for direct compensation to delivery workers, with individuals expected to receive up to $5,000. The remainder will cover fines and fund the development of a software tool for drivers to share data with the city about their payments.

As part of the settlement, DoorDash must submit payment data for workers to the city for three years, enhancing transparency in how workers are compensated. Mamdani emphasized the importance of giving workers the ability to crowdsource data and review the algorithms affecting their earnings.

DoorDash admitted to underpaying workers but asserted that the issue was unintentional. The company acknowledged its failure to meet operational standards, promising to address the shortcomings and improve their payment practices.

Mamdani, however, questioned the unintentional nature of DoorDash’s actions, arguing that the company deliberately excluded certain hours worked from its calculations, particularly after the city mandated a minimum pay rate for delivery workers in 2023.

This settlement follows other significant actions taken by Mamdani against food delivery companies, including a $5 million resolution with Uber Eats for minimum wage violations and a $875,000 settlement with HungryPanda over unlawful fees.
