A severed fiber optic cable recently caused significant disruption to flights on the East Coast. According to Eric Napoli, chief legal officer at AirHelp, customers affected by this are entitled to a full cash refund under U.S. law. This option is available when flight disruptions occur due to issues beyond the airline’s control.
Understanding Your Refund Rights
Napoli explained that under U.S. domestic flight laws, passengers can receive a cash refund if they choose not to take the rescheduled flight. For flights between the U.S. and Europe, European laws typically allow compensation of up to $700 if delays are directly attributable to airlines. However, in this case, the disruption was not the airline’s fault but rather due to external factors, so no European compensation is due.
The Cause of the Disruption
U.S. Transportation Secretary Sean Duffy attributed the cancellations to Amtrak, stating that a construction crew had severed the cable. Amtrak countered by clarifying that it occurred on New Jersey Transit property with their contractor involved. New Jersey Transit acknowledged proximity to the utility markings when the cable was cut.
Rebooking and Refund Options
Napoli highlighted that if you accept an airline’s offer to rebook your flight, you waive the right to a refund. Airlines often present passengers with the option to either take a different flight or receive a refund if they choose not to fly. If passengers opt for the flight, they forfeit their refund eligibility.
Taking Proactive Steps
Napoli urged passengers to actively pursue refunds rather than passively wait. He advised asking airlines for vouchers related to food, transportation, or lodging if applicable. Travelers should be proactive, as airlines focus on rescheduling flights amidst disruption.
Role of AirHelp and Traveler Preparation
AirHelp provides resources through their website and app, offering updates and guidance on refund procedures. Napoli emphasized the importance of remaining informed and calm during such situations, advocating for polite interactions in resolving issues. Anger, he noted, is unproductive.
