Office of Personnel Management Director Scott Kupor has announced significant changes in federal hiring practices under the Trump administration. These changes prioritize merit over Diversity, Equity, and Inclusion (DEI) considerations. Kupor revealed the elimination of self-attestation, the use of skills-based assessments, and increased accountability for underperforming employees. The objective is to reduce inefficiencies and enhance performance within the 2.2 million federal workforce.
The administration, on Wednesday, furthered its efforts to remove long-standing DEI policies, replacing them with merit-based hiring guidelines. The U.S. Office of Personnel Management (OPM) issued a final interim rule on Thursday removing the 1978 Uniform Guidelines on Employee Selection Procedures. These guidelines previously influenced employee selection standards and were deemed unconstitutional due to encouraging race-conscious decisions.
This policy change modifies federal agency hiring approaches by eradicating “disparate impact” references. “Disparate impact” suggested hiring practices might be problematic if they resulted in unequal racial outcomes, even without direct discrimination. Administration officials maintain that past guidelines focused more on racial considerations rather than qualifications. Meanwhile, supporters believe the guidelines helped mitigate subtle discrimination forms.
OPM Director Scott Kupor emphasized the importance of hiring based on merit and qualifications. In a statement to Fox News Digital, he asserted that the rule aligns OPM’s regulations with legal guidance while upholding high standards necessary for recruiting and hiring a competent workforce to serve the American public.
The new rule was immediately effective upon publication in the Federal Register and is available for public comment over 60 days to determine if it becomes permanent.
OPM functions as the federal government’s human resources agency, responsible for setting personnel policies for about 2 million civilian employees in executive branch agencies. This move reflects the administration’s broader approach to dismantling DEI offices, diversity training, and the legal groundwork that critics argue facilitated DEI policies.
Under President Trump’s second term, the administration has targeted various educational institutions and policies tied to DEI initiatives, including transgender athletics, parental rights, and race-focused admission programs. They have also dismantled federal DEI programs, revoked DEI-related grants, and mandated compliance with administrative requirements for federal contractors. Non-compliance could jeopardize federal funding for schools employing certain DEI practices.
