A federal judge has voided the Trump administration’s initiative that imposed a $100,000 fee on companies seeking H-1B visas for skilled foreign workers. This decision marks an important development in the legal landscape surrounding immigration policies.

Judge Leo T. Sorokin of the Federal District Court for the District of Massachusetts ruled that the fee represented an unlawful tax, overstepping Congress’s exclusive right to levy taxes. In his detailed 42-page opinion, Judge Sorokin criticized the administration’s claims that the fee was a regulatory payment rather than a tax.

This is mere ipse dixit. Defendants offer no definition for what constitutes a regulatory payment, cite no cases or statutes employing the term, and advance no reasoned argument explaining how this term encompasses something different than a tax or a penalty.

Judge Sorokin noted the policy was formulated hastily without formal processes or requests for public comment. This occurred despite likely opposition from industries that rely on skilled foreign labor to meet essential needs.

The Trump administration had argued that the H-1B program was being exploited to replace American workers with lower-paid, less skilled labor. The administration suggested the fee would encourage employers to hire U.S. citizens for high-paying jobs.
