Judge Overturns Trump Guidance on Renewable Energy Credits

A decision by a federal judge in D.C. has overturned a guidance issued during the Trump administration that restricted green tax credits. This ruling serves as a victory for supporters of renewable energy, but its overall impact remains uncertain. The judgment arrives just a month before Republican initiatives aim to phase out the credits completely under the ‘Big Beautiful Bill.’

The One Big Beautiful Bill Act of the previous year planned a gradual removal of tax credits for renewable energy sources such as solar and wind. According to the Act, projects need to commence before July 5, 2026, or be operational by 2028 to qualify for these incentives.

The core of this legal dispute involved the IRS’s interpretation of ‘starting construction.’ Judge Colleen Kollar-Kotelly highlighted that since 2013, the IRS had recognized two criteria for projects to begin: initiating ‘physical work of a significant nature’ or incurring expenses amounting to at least five percent of the project’s estimated total cost.

The Trump-era guidance only acknowledged the ‘physical work’ standard, dismissing the five percent expenditure rule. Judge Kollar-Kotelly, appointed by President Clinton, determined this exclusion to be arbitrary and capricious.

However, the judge acknowledged that uncertainty persists for developers due to the looming deadline, impeding clear investment decisions in wind and solar projects. She remarked, ‘Unfortunately, significant uncertainty will exist no matter how this Court resolves this case and what remedy it awards.’
