In Provo, Utah, a preliminary hearing took place for Tyler Robinson, who faces charges for the murder of Charlie Kirk. Fox News correspondent, Matt Finn, reported on this critical court session where prosecutors presented substantial evidence against Robinson. Key elements include video testimonies from Robinson’s former roommate and text message confessions.
James Gagliano, a retired FBI supervisory agent, commented on the Kirk family’s push for transparency, as courtroom cameras captured the proceedings. Utah prosecutors argued that Robinson’s practice shooting sessions showed he “seldom hit the bullseye,” raising concerns about the potential risk to others during the alleged rooftop shooting.
During the incident, Kirk was struck in the neck while addressing an audience at a campus courtyard. The defense claimed the shot originated from the rooftop and did not pose a threat to others, stressing only one shot was fired and hit the intended target.

The prosecution aimed to establish an aggravating factor necessary for capital punishment, arguing the shooting posed significant danger to surrounding individuals. They contended Robinson was aware of this risk.
The defense sought to remove this aggravator pre-trial to avoid a possible death sentence. The court filings emerged post a week-long hearing in July meant to assess probable cause for trial. Judge Tony Graf Jr. anticipated issuing a final decision on September 1.
Prosecutors asserted the necessity to bring Robinson to trial, accusing his legal team of neglecting critical case law during the preliminary hearing. They argued that reasonable inferences, favoring the state, should be drawn regarding the potential risk to bystanders from the shooting.
Robinson, yet to enter a plea, is accused of traveling from Southern Utah to Orem and fatally shooting Kirk during a Turning Point USA event at Utah Valley University in September 2025. Allegedly, he confessed to several people before surrendering to local authorities.
