Tyler Robinson will face trial for the alleged aggravated murder of Charlie Kirk, a right-wing political activist. The decision came from Judge Tony Graf, based on evidence presented by prosecutors. The shooting occurred on September 10, 2025, at Utah Valley University.
Judge Graf ruled there was sufficient evidence to charge Robinson with aggravated murder. The potential penalties include the death penalty, life imprisonment without parole, or 25 years to life with parole. The judge reviewed 24 pages of notes from Robinson’s preliminary hearing.
Prosecutors argued Robinson targeted Kirk intentionally, knowing children were present. They presented evidence over a five-day hearing in July. They claimed Robinson disagreed with Kirk’s political beliefs, and fired a high-powered rifle into a large crowd, putting many at risk.
Erika Kirk, the widow of Charlie Kirk, asked for a determination by September 1. On Tuesday, prosecutors stated that the evidence against Robinson is overwhelming.
The defense focused on contesting the enhancements that could lead to the death penalty. They argued the aggravating factor of knowingly endangering others was not proven, as the shooter aimed and fired a single shot.
Prosecutors countered, asserting that firing into a crowd of 3,000 posed a significant risk. Robinson also faces charges of obstruction of justice and felony discharge of a firearm causing serious injury, with penalties ranging up to life in prison. He has yet to enter pleas for these charges.
