President Donald Trump is under scrutiny for allegedly violating federal criminal statutes. Legal experts are focusing on his cash gifts to White House aides and his pledge to send $5,000 checks to Americans if the Republicans maintain control of Congress in the upcoming midterm elections.
Cash Gifts to Aides
Trump reportedly gave holiday cash gifts totaling $45,000 each to aides Natalie Harp, Margo Martin, and Chamberlain Harris. The Washington Post first reported these gifts. Ethics experts argue these payments may breach 18 U.S.C. § 209, which prohibits executive branch employees from receiving compensation or supplements to their salary from non-federal sources.
Richard Painter, former chief White House ethics lawyer, noted that substantial gifts resemble additional salary rather than genuine gifts, potentially leading to political ramifications like impeachment.
A White House official defended the gifts, stating they are unrelated to government duties and align with ethical standards, citing Trump’s history of giving Christmas gifts.
$5,000 Checks Proposal
During a GOP midterm convention in Dallas, Trump pledged to give $5,000 to every American adult if Republicans win both the House and Senate, likening it to a company’s shareholder distribution.
This pledge raised concerns that it might violate 18 U.S.C. § 597, which bans expenditures influencing voting. Critics, including Painter, questioned the legality of offering monetary incentives linked to election results.
Some argued the proposal is a legitimate campaign promise since it would benefit all Americans regardless of their voting choices.
Democrats criticized the proposal, suggesting it aims to buy votes. California Governor Gavin Newsom condemned it as corrupt.
