The defense team for Alex Murdaugh is requesting a new DNA test in the retrial of the murder case involving his wife and son. Criminal defense attorney Donna Rotunno shared insights on new motions in the case, highlighting the importance of testing any available DNA to ensure truth and justice.

Alex Murdaugh’s attorneys are seeking independent testing of unknown male DNA found under Maggie Murdaugh’s fingernails. They aim to use the expertise of a Texas forensic DNA lab, known for resolving notable murder cases, to explore this evidence as he prepares for a new trial. Murdaugh, formerly a prominent personal injury attorney in South Carolina, was initially convicted in 2023 for the murder of his wife, Maggie, 52, and their son, Paul, 22, at their hunting estate in June 2021. After these convictions were overturned, a new trial is provisionally scheduled for April 2027.

His legal team emphasizes the significance of DNA found under Maggie’s fingernails, purportedly belonging to an unknown male. They are advocating for independent analysis by Othram Inc., a Houston-based company renowned for its success in high-profile murder investigations and cold cases.

The Prosecutors’ Perspective

Prosecutors argue against additional DNA testing, noting that the evidence has already been examined by the South Carolina Law Enforcement Division (SLED). They stated that the sample included a mixture of Maggie’s DNA and a “very partial and incomplete” profile from another contributor. This unidentified profile lacked sufficient information for submission to CODIS, the national DNA database.

Othram’s approach to forensic genetic genealogy can offer potential breakthroughs when traditional law enforcement databases do not yield results. The company has been instrumental in solving the following notable cases:

  • University of Idaho Murders: Othram helped identify Bryan Kohberger as the suspect in the 2022 murders of four students after investigators recovered DNA from a knife sheath.
  • Rachel Morin Murder: DNA analysis by Othram led to the arrest and conviction of Victor Martinez-Hernandez for the murder of Maryland mother Rachel Morin.
  • Carla Walker Cold Case: Advanced DNA testing assisted in identifying the killer of Carla Walker, solving a case that remained unsolved for over 40 years.
  • Lady of the Dunes: Othram identified the “Lady of the Dunes” as Ruth Marie Terry, resolving a nearly 50-year-old mystery.
  • Fire Island Jane Doe: Identified as Karen Vergata, this case linked to the Gilgo Beach investigation was resolved with Othram’s technology.

Implications for Murdaugh’s Case

The request for Othram testing, while not guaranteed to alter the outcome, is expected to support the defense’s alternate-suspect theory in Murdaugh’s upcoming trial. Defense attorney Dick Harpootlian criticized the initial investigation, suggesting it excluded other possibilities.

Prosecuting attorney Creighton Waters dismisses the request as lacking support, suggesting it is more of a public display than genuine forensic evidence. During Murdaugh’s status hearing on June 29, Judge Debra McCaslin instructed defense attorneys to confirm the viability of the DNA sample. Murdaugh’s retrial continues to attract attention as legal teams prepare for the next phase.
