Attorney General’s Role in Cornell Assault Investigation Questioned

New York Attorney General Letitia James faces scrutiny over her involvement in the investigation of an alleged sexual assault at Cornell University. Andrew Miltenberg, representing one of the accused former fraternity members, suggests James should step aside due to concerns over her impartiality. Miltenberg argues James showed bias through previous comments supporting the accuser.

Attorney General James had described the alleged victim’s experiences as ‘horrific and unacceptable,’ raising questions about her neutrality. Miltenberg emphasizes that impartiality is crucial for public confidence in the investigation.

New York Governor Kathy Hochul recently placed James’ office in charge of the investigation, replacing Tompkins County District Attorney Matthew Van Houten. This change followed a civil lawsuit filed by the alleged victim, identified as Jane Doe, claiming that seven former fraternity members drugged and assaulted her in October 2024 at the Chi Phi fraternity house. The accused men deny such actions, with claims ranging from consensual encounters to non-involvement.

Critics, including defense attorney Donna Rotunno, echo Miltenberg’s concerns. Rotunno stresses the importance of a fair and unbiased investigation, suggesting that public statements can undermine this by impacting perceived impartiality.

Miltenberg calls for James to recuse herself while allowing other senior prosecutors, who have not publicly commented, to lead. This, Miltenberg argues, could enhance public trust in the investigation’s fairness.

Initially, Van Houten chose not to file criminal charges, citing insufficient evidence. However, the case was revisited following the lawsuit’s filing. Concerns arose over the completeness of the investigative records previously reviewed by the district attorney’s office.

Cornell University has agreed to an independent review of its handling of the allegations. University President Michael Kotlikoff stated that disciplinary actions had resulted in expulsions and suspensions, though these are separate from criminal proceedings.

Cornell supports the special prosecutor’s involvement and commits to an external reassessment of how it managed the case. The pursuit of unbiased legal outcomes and public confidence remains a central focus as the investigation continues.
