Challenges to Undocumented Children Attending Public Schools

Certain states are attempting to contest a long-standing principle that permits undocumented children to access public education at no cost.

Since 1982, following the decision in Plyler v. Doe, public schools across the United States have been required to offer education to all students, irrespective of their immigration status. This Supreme Court ruling overturned a previous Texas law enacted in 1975, which had allowed public schools to either charge tuition fees to immigrant students or deny them admission altogether.

The decision ensured that education remains accessible to immigrant children, emphasizing the importance of equal access to schooling for all.
