Delay in Lindsay Clancy Mistrial Investigation Motion

The legal team for Lindsay Clancy and Massachusetts prosecutors have agreed to postpone the motion for investigating the sole holdout juror in her mistrial case. This agreement awaits approval from Judge William Sullivan, who has not yet made a decision.

The postponement is due to the inability of the juror’s counsel to access impounded information necessary for preparing a response. Edward Paltzik, the defense attorney, explained that both the District Attorney and defense attorney Kevin Reddington have consented to adjourn the motion to investigate the holdout juror, Michael Desronvil.

“If Judge Sullivan signs an order today, much of it could be adjourned. Either way, a status conference is still likely. But the motion about Michael is likely not on tomorrow,” said Paltzik.

In recent developments, Michael P. Desronvil, the sole holdout juror in Clancy’s mistrial, has retained an attorney who previously represented President Donald Trump. Clancy faced charges of first-degree murder in the deaths of her three children. Her next court appearance is scheduled for a status conference.

Paltzik mentioned, “We have our local counsel showing up either way. It’s important to note that all of this is subject to the Judge’s discretion.” The hearing was set to discuss Reddington’s motion to inquire about Desronvil’s role as a holdout and a double jeopardy motion to dismiss charges instead of proceeding with a retrial.

Reddington has requested an investigation into Desronvil, the only juror who maintained Clancy’s guilt in the deaths of her children. The other jurors agreed with an insanity defense, claiming Clancy suffered from postpartum psychosis.

Paltzik also raised questions about why Reddington did not object to Desronvil’s participation during jury selection. Reddington had 16 strikes to use for removing potential jurors before the trial.
