Fairfax County Crime: Policy Debate over Illegal Immigrant Offenses

In Fairfax County, Virginia, a rise in crimes committed by illegal immigrants, including murders and child sex offenses, has intensified debates about sanctuary city policies and their effects on public safety. A report from the Department of Homeland Security (DHS) indicates that 75% of all murders in the county involve illegal aliens. This has sparked scrutiny of local policies.

Recently, a Honduran illegal immigrant, Oscar Evaristo Nunez, facing several child sex crime charges, was taken back into federal custody. The Department of Homeland Security reports that he was released by local authorities without notification, despite an immigration detainer placed by U.S. Immigration and Customs Enforcement (ICE).

Nunez was initially detained on August 27, 2025, for aggravated sexual battery involving children and offenses related to the non-consensual filming of a minor. ICE filed a detainer shortly after, but local authorities in Fairfax County did not honor it, releasing Nunez without informing ICE.

The case highlights ongoing tension between the Trump administration and Virginia officials around cooperation with federal immigration enforcement. DHS Secretary Markwayne Mullin criticized Fairfax County’s decision to release Nunez, labeling him a criminal who was allowed back on the streets by sanctuary politicians.

Political dynamics are also at play, with Democrat Spanberger, who took office in January 2026, prioritizing a move away from state participation in federal immigration enforcement. This included ending state agency agreements with ICE under the federal 287(g) program.

Fairfax County representatives have yet to comment on the situation. Nunez, who DHS states entered the U.S. illegally through Arizona in 2003, remains in ICE custody awaiting immigration proceedings.
