Former Federal Prosecutor Sues Justice Department Over Alleged Political Dismissal

A former federal prosecutor has filed a lawsuit against the U.S. Department of Justice. Sunita Doddamani, who served as an assistant U.S. attorney in the Eastern District of Michigan, claims she was unlawfully fired for political reasons related to her prosecution of anti-abortion activists.

Doddamani’s complaint accuses the Justice Department of conducting a politically motivated and retaliatory dismissal. She argues that her firing placed her in violation of the Civil Service Reform Act, the Administrative Procedure Act, and the First and Fifth Amendments. The lawsuit states that she was terminated on April 13 without prior notice or any underlying cause.

The alleged reason behind her dismissal was her involvement in prosecuting eight anti-abortion activists charged with violating the Freedom of Access to Clinic Entrances Act (FACE Act). This federal law prohibits obstructing access to reproductive health services, including abortion. According to the lawsuit, at least two other prosecutors who worked on FACE Act cases also faced termination on the same day.

The Justice Department publicly stated that it had ended the employment of those “responsible for weaponizing the FACE Act who remained at the department.” Just a day later, a report was released suggesting the Biden administration used the FACE Act against anti-abortion activists.

The lawsuit claims unlawful terminations were used as political tools during the Trump administration to achieve its aims. It accuses Justice Department officials of justifying firings by labeling the targeted employees as responsible for controversial cases.

Doddamani claims to have suffered various adverse effects due to her dismissal. These include loss or jeopardy of current and future financial opportunities and damage to her reputation. The lawsuit names seven defendants, including Attorney General Todd Blanche and seeks her reinstatement, backpay, and other relief.

The FACE Act, established in the early 1990s, aimed to address violence against abortion clinics and providers. Its opponents argue it restricts free speech rights for abortion opposition. During President Trump’s second term, the Justice Department limited FACE Act enforcement except in cases of death or significant property damage. Trump also pardoned 23 individuals convicted under the law.
