A Georgia mother, Lindsay Shiver, is embroiled in a legal dispute after accusations of conspiring with her alleged lover, Adrien Bethel, to hire a hitman for her ex-NFL player husband, Robert Shiver. Her attorney argues that jurisdictional issues undermine the prosecution’s case in the Bahamas.
Jurisdictional Dispute
Shiver’s U.S. attorney claims that Bahamian prosecutors lack jurisdiction over the murder-for-hire charges. The allegations center on events that supposedly transpired while Shiver was in the United States. Her attorney, Craig Shirley, stated unequivocally, “Lindsay Shiver is not guilty of the crimes alleged against her by the Bahamian Director of Public Prosecutions (DPP).”
The indictment suggests Shiver was in the Bahamas on July 16, 2023, during the alleged conspiracy. However, Shirley insists they have submitted independent evidence showing her presence in the U.S. on that date. This raises critical jurisdictional issues concerning the prosecution under Bahamian law.
Legal Challenges
Shirley highlights the jurisdictional defect as a significant barrier to prosecuting Shiver under the Bahamian Penal Code. He stated, “Lindsay cannot be prosecuted under the Bahamian Penal Code for an alleged act committed at a time when the undisputed evidence establishes that she was not in The Bahamas.” He describes this as more than a technicality, emphasizing a severe weakness in the DPP’s evidence.
Expressing dissatisfaction with the ongoing prosecution, Shirley remarked, “Lindsay should never have been subjected to a prosecution that the Bahamian government lacked the legal authority to bring.”
Discovery of the Alleged Plot
The alleged plot was discovered amid an unrelated investigation in Abaco, Bahamas. During a break-in probe at a local bar, police found WhatsApp messages on a suspect’s phone that reportedly included instructions from Shiver to “Kill him,” referring to Robert Shiver. Shiver’s defense team argues that the messages are being misinterpreted.
Shiver, along with Bethel and the alleged hitman, Faron Newbold Jr., were arrested in the Bahamas in July 2023. They face charges of conspiracy to commit murder but have pleaded not guilty.
