A federal judge has mandated the Trump administration to initiate the 2027 Diversity Visa lottery. This order comes after the administration did not start the registration period on time for the green card program.
Legal Ruling
On Wednesday, U.S. District Judge Jinsook Ohta issued a preliminary injunction. The injunction requires the State Department, led by Secretary of State Marco Rubio, to establish a registration period for the 2027 program. Prospective applicants now have the opportunity to enter the green card lottery. The State Department must process entries until either all 55,000 visas are assigned or the fiscal year 2027 concludes.
Judge Ohta commanded the department to announce and open the DV-2027 registration by midnight Eastern time on Thursday. Curtis Morrison, an attorney with Red Eagle Law L.C., confirmed this development. The registration period is mandated to stay open for no less than 30 days.
Government Stance
The Trump administration has been critical of the Diversity Visa program and did not open registration for DV-2027 before the previous fiscal year ended. In court, the government argued that a delayed registration would conflict with regulations about the program’s timing. Red Eagle Law filed the lawsuit against Marco Rubio, questioning the Department’s delay under the Administrative Procedure Act.
Changes in Immigration Policy
Since President Donald Trump began his second term, his administration has intensified scrutiny on legal immigration processes. This includes visa and humanitarian programs, in addition to a broader immigration enforcement strategy.
About the Diversity Visa Program
Established by Congress in 1990, the Diversity Visa program seeks to offer green cards to qualified individuals from countries with low rates of U.S. immigration. Despite winning the lottery, recipients need to fulfill immigration requirements to acquire a visa.
