A group of lawmakers has issued a stern warning to the Trump administration about the potential for fines and criminal prosecution if plans to construct a 250-foot triumphal arch in Washington proceed without congressional approval. This warning was communicated through a letter addressed to Interior Secretary Doug Burgum and officials from the National Park Service.
The letter was signed by Democrats who oversee natural resources on Capitol Hill and an independent senator, clearly stating that moving forward without Congress’s approval would violate at least three laws. Those responsible for using unauthorized funds could face severe consequences, including suspension without pay, removal from office, and criminal fines or imprisonment for willful violations.
Senator Angus King, an independent from Maine who collaborates with the Democrats, along with Representative Jared Huffman of California, the highest-ranking Democrat on the House Natural Resources Committee, were among the signatories. They emphasized that the administration’s actions would breach the Commemorative Works Act, which regulates monuments on federal land in Washington. Furthermore, a 1912 law prohibits the erection of buildings or structures on federal land in the capital without explicit congressional approval. Additionally, the Height of Buildings Act generally restricts structures in Washington to a maximum height of 160 feet.
Senator King strongly opposed the arch construction, stating, “This project is stone-cold illegal. It is one of the clearest legal cases I’ve seen in more than 50 years of being a lawyer.”
These developments have added significant tension and raised serious legal questions over an ambitious construction proposal that lacks the necessary legislative backing.
