Royce White’s Legal Challenge Against WNBA Eligibility Standards

Former NBA player Royce White intends to pursue legal action against the WNBA following Commissioner Cathy Engelbert’s statement to Congress. Engelbert commented that White and Enes Kanter Freedom are deemed ineligible to play as they are men. White criticized Engelbert’s response, questioning the league’s eligibility guidelines and demanding clarification on its definition of men and women.

“We plan to explore every legal avenue possible to hold the WNBA and NBA community to their stated standards and values,” White stated. This dispute arose as White and Freedom sought entry to the 2027 WNBA Draft after expressing that they identify as women.

Engelbert addressed an Oct. 16 letter to Republican lawmakers, confirming that “only women are eligible to play in the WNBA and the individuals you cite in your letter are both men.” This response followed an inquiry by Rep. Marlin Stutzman and colleagues regarding the WNBA’s definitions under its collective bargaining agreement.

The agreement mentions that “only players who are women are eligible to play,” lacking clarity on gender identity or sex assigned at birth. White insists that understanding this distinction is central to his claims. “No, we’re not letting them off that easy,” he expressed. “She has to define, and the WNBA has to define, what a man and a woman is and why.”

White also called on NBA Commissioner Adam Silver for involvement. The NBA had previously deemed the duo ineligible via statements from league sources. White, identifying as a fan of women’s basketball, emphasized the need for less political interference to preserve the sport’s integrity.

White has been actively following the WNBA Finals and contemplates attending games, without disclosing specifics due to security concerns. He is monitoring the competition closely.
