The International Criminal Court (ICC) Prosecutor Karim Khan has been removed from his position after member states voted him out due to sexual misconduct allegations. This marks the first instance of a sitting chief prosecutor being dismissed from the ICC.
The Assembly of States Parties, the ICC’s governing body consisting of 125 members, decided Khan’s fate following an investigation into allegations involving a junior female staffer. Khan has denied any wrongdoing.
The situation escalated as the ICC’s warrants against Israeli Prime Minister Benjamin Netanyahu became a contentious topic. New York Mayor Zohran Mamdani’s ambition to arrest Netanyahu was fueled by the ICC’s actions, but he later acknowledged the city’s lack of authority in enforcing the warrant.
Khan pursued ICC arrest warrants for Netanyahu and former Israeli Defense Minister Yoav Gallant over Israel’s actions in Gaza, leading to criticism from both Israel and the United States.
The ICC, located in The Hague, prosecutes individuals for genocide, war crimes, crimes against humanity, and aggression when national courts fail to act.
Allegations against Khan included misconduct towards a female aide identified as Sarah. She stated the impossibility of consent given the power disparity. While Khan challenges the decision, his legal team argues due process was ignored, citing investigations that found no misconduct.
Israeli officials accused Khan of launching politically motivated actions against Netanyahu to deflect attention from his own scandal. The removal of Khan, they believe, undermines the legitimacy of the ICC’s actions regarding Israel.
International response to Khan’s case suggests his actions tainted the integrity of the ICC and its proceedings against Israel.
The ICC has not commented on whether the removal impacts the warrants for Netanyahu and Gallant, which were issued based on Khan’s request.
