Washington’s Lincoln Memorial Reflecting Pool Case Ends
In an unexpected turn of events, the Justice Department has dropped charges against David “Davey” Hearn, a former Olympic canoeist, who was accused of vandalism. The case concerned damage to the Reflecting Pool near the Lincoln Memorial.
A recent filing revealed that information from the Interior Department exposed flaws in the indictment. Officials received documents indicating the pool’s damage resulted from inadequate installation by Atlantic Industrial Coatings rather than vandalism.
Lack of Evidence for Vandalism
The Justice Department commented on the insufficiency of evidence linking the damage to deliberate acts. They stated, “it is difficult to attribute the widespread damage to the Reflecting Pool to vandalism, let alone establish that fact beyond a reasonable doubt.”
Hearn had previously defended himself by asserting the pool’s condition remained the same after he touched the water. He always maintained his innocence, stating he did not cause more than $1,000 worth of damage to the structure.
Legal Proceedings Acknowledged as Misguided
“The Government’s case against Davey Hearn should never have been brought,” said Steven Levin, Hearn’s attorney. He criticized the government’s strategy of “ready, shoot, aim,” calling for an apology from federal authorities.
Authorities, led by Jeanine Pirro at the U.S. Attorney’s Office for the District of Columbia, acknowledged the inadequate basis for Hearn’s indictment.
Further legal actions, including dismissing other misdemeanor charges, are in progress. The government aims to reassess the handling of cases related to the Reflecting Pool incident.
This development updates ongoing investigations related to the pool renovations completed in June. A National Guard member had been seen patrolling the area, emphasizing continued security concerns.
