James Comey’s legal team argued in a federal court in North Carolina that a prosecution case against the former FBI Director would undermine constitutional rights. They stated the case, motivated by President Trump’s hostility, aims to punish Comey for his protected speech.
Comey’s attorneys requested the judge to dismiss the case, claiming it was based on a misuse of legal principles, intended to retaliate against Comey. They argued that historically, the Department of Justice maintained its integrity to prevent political reprisals through legal actions. However, Comey’s case represents a deviation from this tradition.
The defense team also sought access to grand jury records. They expressed concerns about irregularities in the indictment process, suggesting the usual presumption of normality does not apply here.
Previously, Comey’s lawyers argued that his Instagram post, involving the number “8647”, did not constitute a true threat. They contended the post did not align with any reasonable interpretation of a threat, dismissing the claims as lacking basis in reality.
A Justice Department official anonymously criticized the case as a waste of resources. They believed it lacked substance, doubting a potential trial.
Charges against Comey were announced by Acting Attorney General Todd Blanche along with other officials. Should the case proceed, Comey’s arraignment is set for September 30, with a trial in New Bern, North Carolina, from October 21.
Matthew Petracca, initially involved in the case, withdrew in May. The junior attorney, with limited federal experience, now works in the Civil Division. Assistant U.S. Attorney Timothy Severo currently leads the prosecution.
Arguments of selective prosecution have been made regarding previous cases against Comey. Earlier, claims of bias in a case involving a former White House aide were not addressed by a court. The case was dismissed due to legality issues concerning the aide’s position.
