Supreme Court Allows Alabama to Use New Congressional Map

The Supreme Court made a pivotal decision in 2023, clearing the path for Alabama to utilize a congressional district map that features just one majority-Black district. This decision is seen as a victory for Republicans aiming to secure their narrow majority in the House.

This ruling marked the first significant test following the court’s April move to diminish provisions of the landmark Voting Rights Act of 1965. The consequence of the four-page ruling, which was issued unsigned, is that Alabama can replace its existing map — which includes two majority-Black districts — with one having only a single majority-Black district. This shift potentially favors Republicans by increasing their chances of reclaiming the seat for a conservative representative.

The court’s decision witnessed dissent from its three liberal justices. The majority conservative justices argued that a unanimous three-judge panel had previously erred in late May when it blocked Alabama’s map, ruling it racially discriminatory. The majority believed the lower court did not comply with the Supreme Court’s recent Voting Rights Act ruling.

In their opinion, the majority stated that the lower court had overstepped by interfering with elected officials as they prepared for an upcoming election. They emphasized that states should have the autonomy to decide if changes close to an election serve their best interests.
