A toddler in a Phoenix suburb, initially declared dead after being found in a backyard pool, was discovered breathing hours later in the hospital morgue room, according to police records. Gilbert police officers noted signs of life but the child was still placed in the hospital’s “cold room” following medical treatment.
First responders were called to the home around 5:30 p.m. on February 8 after a reported drowning incident. Emergency measures were conducted, and the child was taken to the hospital where he was pronounced dead about an hour later. However, about five hours later, he was found breathing and was transferred to another hospital. The boy eventually survived and was released.
Parental Negligence Under Review
Police recommend negligence charges against the parents, citing a noticeable marijuana odor at the home and open doors leading to pool access. The Maricopa County Attorney’s Office is currently reviewing the case. Relatives’ calls to 911 described frantic scenes with the child being pulled from the pool and appearing unconscious.
Attempts to reach the family for comment were unsuccessful as no one responded at the home on the reported incident day.
Hospital’s Response and Legal Aspects
Mercy Gilbert Medical Center, where the child was initially taken, stated they are investigating the care provided and seek to implement improvements. Scott Holden, attorney for Dr. Aryan Toosi, indicated there is more information regarding the case that is not yet revealed.
A GoFundMe page for the child’s family mentions that the toddler still requires extensive therapy.
Historical Context and Expert Opinions
Instances of mistakenly declared deaths, though rare, do occur. In Michigan, a case involving a 20-year-old woman mistakenly declared dead highlights similar issues. Dr. Judy Melinek, a forensic pathologist, explains that determining death involves confirming no heartbeat, breathing, or neurologic activity. Mistakes can stem from inexperience or policy failures, emphasizing that once declared dead incorrectly, it comes as a shock when individuals are found alive.
