Trump Requests Dismissal of NAACP Suit Against xAI Over Pollution Claims

In April, the NAACP claimed that xAI did not secure an air pollution permit for its Colossus Gas Plant. This facility powers the Colossus 2 data center, essential for the operation of the AI chatbot Grok.

On Monday, the Justice Department filed a request to dismiss this lawsuit. The Department stated that the enforcement of the Clean Air Act lies with the United States Government. The Trump administration emphasized that Grok’s functionality is critical for national security. It cited Grok as one of four AI platforms supporting national security tasks, and among three capable of handling sensitive operations on Secret and Top-Secret networks.

The NAACP’s lawsuit argued that the plant, which comprises 27 gas turbines, releases substantial pollution linked to health issues. These include asthma, respiratory problems, heart disease, and some cancers. It also highlighted that the population living near the plant has a high percentage of Black residents.
