Virginia Prosecutor Rejects New Gun Ban, Citing Constitutional Concerns

Ryan Mehaffey, a Marine veteran and prosecutor in Virginia, strongly opposes a new gun ban signed by Democratic Governor Abigail Spanberger. The law bans future sales and manufacture of ‘assault weapons,’ which includes many semiautomatic firearms, and restricts magazine capacity over 15 rounds. This move sparked backlash and Second Amendment concerns among Virginians.

Mehaffey, serving as the commonwealth attorney for Spotsylvania County, refuses to enforce the ban. He sent a letter to Sheriff Roger Harris describing the ban as ‘unconstitutional.’ Mehaffey argues that the Second Amendment ensures community defense through a well-regulated militia and believes this ban undermines that principle.

According to legal expert commentary, the ban is seen by some as political theater. Mehaffey contends that the Second Amendment protects the right to own a basic infantry weapon, which is crucial for defense. He notes the historical tradition in Virginia, where citizens were expected to arm themselves similarly to an infantryman.

In response, Commonwealth’s Attorney Phillip Blevins of Smyth County also refuses to enforce the ban, highlighting constitutional fidelity over political concerns. He emphasizes his oath to support the U.S. and Virginia Constitutions, regardless of political pressure.

Gun-rights groups like the NRA and Second Amendment Foundation are challenging the ban in court, arguing that it violates constitutional rights. Mehaffey believes that eventually, the courts will uphold the Second Amendment as the supreme law.

Despite receiving personal attention, Mehaffey stresses his commitment to serving the public faithfully and defending their rights. He urges government officials to adhere to constitutional principles in their duties.
