Lawyers representing a former U.S. Olympian want federal watchdogs to investigate the Justice Department’s actions in a case against their client. David Hearn, initially accused of damaging the Lincoln Memorial Reflecting Pool, was later found not responsible. On Tuesday, his attorneys asked the inspectors general of the DOJ and Interior Department to examine the investigation process.
According to Hearn’s attorneys, officials overlooked key evidence and acted under pressure from former President Trump. Their complaint followed a ruling by D.C. Superior Court Judge Todd Eldeman who dismissed the case permanently. Eldeman criticized the speed of the indictment and prohibited the DOJ from recharging Hearn.
Judge Eldeman found a strong likelihood of political influence, noting the U.S. Attorney’s office might try to restart the case due to Trump’s pressure. “The requested investigations aim to uncover facts through witness interviews and analysis of documents, holding accountable those who failed Mr. Hearn, the justice system, and the public,” wrote Hearn’s lawyers.
Hearn faced felony property destruction charges in June, accused of harming the Reflecting Pool’s liner. The charge was dropped after the Interior Department presented evidence showing Hearn’s innocence. Issues with the pool’s renovation, linked to a rush to complete it for America’s 250th birthday, were the true cause of the damage.
Hearn’s attorneys argue that exculpatory evidence was available before prosecutors dropped the case. “The indictment process was notably quick, influenced by political pressure and based on a flawed investigation,” they stated.
