Legal Action Following Tragic Death at Texas BBQ Restaurant
In a separate incident, a tragic event occurred at Green Mesquite BBQ in Austin, Texas. Kirk Foyle, a 64-year-old father of four, died after being struck by a falling pecan tree while dining on the restaurant’s outdoor patio. The Foyle family is suing the restaurant and neighboring property owners, citing negligence.
The lawsuit alleges the tree, referred to as the ‘Widow Maker,’ showed visible signs of disease and decay but was never properly inspected or maintained. The complaint states the defendants should have been aware of the tree’s dangerous condition and acted with reasonable care.
According to the lawsuit, the tree’s compromised condition was evident and had existed long enough for the businesses to have known of the risks. The tree reportedly broke suddenly during storms, resulting in Foyle’s death from blunt trauma as confirmed by the Travis County Deputy Medical Examiner.
Green Mesquite claims the tree had been struck by lightning on the night of the incident, but Foyle’s family disputes this, attributing the tragedy to poor maintenance. The filing mentions a significant financial transaction made shortly after Foyle’s death, raising further questions about property management practices.
The Foyle family seeks $1 million in damages for gross negligence, mental anguish, and legal expenses. The defendants have been contacted for comments regarding the ongoing legal case.
